Welcome to the Dialogue Website www.dialogue-in-the-dark.com, www.dialogue-in-silence.com, www.dialogue-with-time.com or www.dialogue-se.com operated by Dialogue Social Enterprise GmbH, Alter Wandrahm 5, 20457 Hamburg, Germany (“Dialogue”, “we” or “us”). We are a social enterprise with the mission to facilitate social inclusion of disabled and disadvantaged on a global basis. The number of people with disability is growing due to an aging population and an increase in chronic illnesses related to higher life-cycle expectancies. Our goals are
o to raise awareness about the contribution to society by people with disability, leading to an inclusive behaviour, and
o to improve the social economic condition of handicapped people, especially blind, visually and hearing impaired people.
To achieve these goals we operate exhibitions, workshops, and events worldwide. We developed a social franchise system and work with local partners and organizations globally (“Local Partner”).
We encourage you to read the Terms of Use carefully. YOU MAY NOT USE THE WEBSITES OR SERVICES IF YOU DO NOT AGREE TO THE TERMS OF USE.

1. Contract with Dialogue

1.1 Services free of charge

On our websites www.dialogue-in-the-dark.com, www.dialogue-in-silence.com, www.dialogue-with-time.com and www.dialogue-se.com (“Websites”) you can find information about us and the services, such as our workshops (“Workshops”) and exhibitions ("Exhibitions") that we offer. The use of the Websites is free of charge.

1.2 Paid Services

On the Websites you cannot directly book one of our Workshops. You may contact us to request one of our Workshops, using the “Request for Workshop Offers” form. In case we have a license partner in the workshop location requested, we will forward your request to the relevant Local Partner. In order to book one of our Workshops one of our Local Partner will contact you and conclude an agreement with you. You may also go on the websites of our Local Partners and book the Workshops and other services on their websites. In either case the terms and conditions of our Local Partners will apply to the agreement regarding the Workshop.

2. Content on the Websites

2.1 Operator

We operate the Websites and provide the content on it. You may not use any of the content without our prior written consent.

2.2 Geographic Availability

Available services may vary depending on your region. In addition, there may be limits on where we can provide services, such as the Workshops. Please contact the Local Partner for your region to confirm whether they can offer the services. We or our Local Partners are not obligated to offer the same services in all of the regions.

3. Copyrights

We hold the copyrights or rights of use to all pictures, videos and texts published on our Websites, unless the contrary is clearly indicated. It is not allowed to use any pictures, videos or texts from the Websites without our explicit consent.

4. Liability

For any services rendered through the Websites, we shall only be liable in case of intent or gross negligence. In all other respects we are not liable provided that we have not violated essential contractual obligations.

5. Data Protection

We take the security and protection of its users’ personal data very seriously. All information on data protection and the use of cookies can be found in the current privacy policy.

6. Final Provisions

6.1 Choice of Law

The laws of the Federal Republic of Germany shall apply.

6.2 Jurisdiction

The exclusive court of jurisdiction for any disputes arising directly or indirectly from the relationship between the user of the Websites and Dialogue shall be the Regional Court of Hamburg.

6.3 Severability Clause

Should single or several provisions of these Terms of Use be or become void, invalid or unenforceable, this shall not affect the validity of the remaining provisions of these Terms of Use. In such an event, the Parties shall replace the void, invalid or unenforceable provision with a valid or enforceable provision that comes as close as possible to the economic intention of the parties. The same applies to any contractual loopholes in these Terms of Use.
